Chapter 7 vs. Chapter 13

Most Consumer bankruptcy cases are filed under Chapter 7 of the Bankruptcy Code.

Chapter 7 is the type of bankruptcy that most people think of when they hear about
bankruptcy and it is also the most popular type of bankruptcy.  In order to qualify for
Chapter 7 relief, your income typically must not exceed a certain level. We will be
happy to discuss your situation with you and determine if you qualify for Chapter 7
Bankruptcy.

Although this chapter is referred to as liquidation, you are entitled to many
"exemptions" that will allow you to keep most, if not all of your personal property
after filing for Chapter 7 relief. In most cases, the exemptions will exhaust the
bankruptcy estate and consumers will be able to keep all of their property. Chapter 7
bankruptcy does not require you to develop a plan to pay back your debts over a
period of time.

Typically, a court appearance is not required for a Chapter 7 case. There is however,
a mandatory creditors’ meeting that must be attended after filing your case. This
meeting takes place approximately 30 days after filing your case and is regularly
concluded in five to ten minutes.
